
Property Owners: DID YOU KNOW????
- If the County decides to rezone your property (as part of a comprehensive rezoning), and your use of the property does not conform to the new zoning classification, your use is categorized as a non-conforming use. While you are allowed to continue the use (despite the fact that it is a non-conforming use), there are limitations to your ability to expand the use in the future.
- If a Special Exception has been issued for the way that you are currently using your property (say, you own and operate a day care in a residential zone) and you want to increase the intensity of the use (increase enrollment of your day care center), you will likely be required to petition the Board of Appeals for an permitted enlargement, extension, or modification of an existing special exception use.
- If you live in the Critical Area Overlay Zone, and you want to build a new house, shed, or deck, you will be required to comply with the County’s approved Critical Area Program, which, amongst other things, limits the amount of impervious surface (e.g. concrete, brick paving, etc.) allowed on your property.
- Notwithstanding the density and use provisions in the County’s Zoning Ordinance, if you own 40,000 square feet of land and you want to subdivide it, you must obtain an approved Forest Stand Delineation and a Forest Conservation Plan (subject to certain enumerated exemptions).
